Terms of Service
The rules of the road. These are the terms for using PathQuest. They’re a contract — using the app means you accept them — but they’re written in plain language because contracts shouldn’t be a riddle. Read them once and keep them around; if something isn’t clear, you can always get in touch.
1. Accepting these terms
By downloading or using PathQuest, you agree to these terms. If you don’t agree with them, don’t install the app.
2. Who we are
PathQuest is an indie iOS app made by Juan Carlos Castellet, a solo developer based in Castellón, Spain. References to “we” or “us” mean me. References to “you” mean the person using the app.
3. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use PathQuest on devices you own or control, as permitted by Apple’s App Store Terms of Service. The license is for personal, non-commercial use. You don’t own a copy of the software — you have permission to use it.
You agree not to sell, sublicense, rent, modify, decompile, or reverse-engineer the app, except to the extent that local law expressly grants you that right. EU users in particular retain non-waivable rights to interoperability and source-code analysis under Directive 2009/24/EC; we respect those.
4. App content and original works
Most of what lives inside PathQuest — the artwork, the illustrations, the interface text, the names of fictional quests, and the original written and visual material throughout the app — is original work, protected by copyright and other intellectual-property rights. You’re welcome to enjoy it as part of using the app; please don’t copy, redistribute, or repurpose it elsewhere without our written permission.
Where the app references real-world names, places, routes, or historical events, those references are factual and belong to nobody in particular. The fictional content alongside them — characters, narratives, made-up locales — is invented. Any resemblance between a fictional element of PathQuest and a real person, organisation, event, or other published work is coincidental and unintended.
5. Your HealthKit data is yours
PathQuest reads daily step counts and walking distance from Apple’s HealthKit, with your explicit permission, only to compute progress along your quests. We do not transmit, sell, share, or use HealthKit data for advertising or any other purpose. You can revoke HealthKit access at any time in Settings → Privacy & Security → Health → PathQuest. The app will still open and remain navigable, but the features built around tracking your progress won’t have anything to work with until you re-enable it.
6. Premium features and subscriptions
Some features are part of a paid premium tier. Apple handles all billing. Purchases, refunds, subscription renewals, and cancellations are managed through your Apple ID — not through us. You can manage subscriptions at Settings → your name → Subscriptions.
Subscription pricing, the renewal cycle, and the free trial (if any) are shown in the App Store and inside the app before you confirm. If a payment is reversed by Apple or your card issuer after a premium feature has been enabled, we may disable that premium feature.
7. Acceptable use
A short list of “please don’t”:
- Don’t use the app to break the law.
- Don’t tamper with the app’s network traffic, local data, or signing.
- Don’t try to bypass paid features by reverse-engineering or repackaging the app (subject to the EU rights mentioned in section 3).
- Don’t use the app to harass, mislead, or harm others.
If you spot a security issue, please get in touch before disclosing it publicly — we’ll thank you, fix it, and credit you in the release notes if you’d like.
8. The app is provided “as is”
PathQuest is a fitness motivation tool, not a medical device. It does not provide medical, health, or fitness advice. If you have any health condition that might be affected by walking, please consult a qualified medical professional before using the app to set distance goals.
To the maximum extent permitted by applicable law, we provide the app on an “as is” and “as available” basis, without warranties of any kind. We don’t warrant that the app will be uninterrupted, error-free, or compatible with every device or every iOS version.
9. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages — including loss of data, lost profits, or business interruption — arising from your use of PathQuest. Nothing in these terms limits any liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or willful misconduct, and nothing here affects the mandatory consumer-protection rights you have under the law of your country of residence.
10. Service availability and changes
PathQuest is a small, evolving project. We may add, change, or remove features, content, or quests at any time, and we may pause or discontinue the service entirely without prior notice. We won’t revoke premium features from an active subscriber mid-period for arbitrary reasons; if the service is discontinued, any refunds for unused subscription time follow Apple’s standard rules.
11. Termination
You can stop using PathQuest at any time by uninstalling it. We may suspend or terminate your access if you materially violate these terms. Sections 5 (HealthKit), 8 (as is), 9 (liability), and 13 (governing law) survive termination.
12. Changes to these terms
These terms may change from time to time as the app evolves. The date at the top of this page reflects the latest revision; it’s worth checking back occasionally. Continued use of the app after a change counts as acceptance. If you don’t agree with a change, you can stop using the app — that’s always an option.
13. Governing law and venue
These terms are governed by the laws of Spain, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with them shall be submitted to the exclusive jurisdiction of the juzgados y tribunales de Castellón, with the parties expressly waiving any other venue that might otherwise apply.
If you are a consumer resident in the European Union, this clause does not deprive you of the protection of the mandatory provisions of the consumer-protection law of your country of residence.
